Dr. Dipak Desai speaks out in the form of a press release. The doctor could be facing criminal charges and is facing civil lawsuits as a result of the operation of his Endoscopy Center.

Although he has been quiet so far, the doctor at the center of a major public health outbreak in Las Vegas issued a statement on Monday.

Dr. Desai could face criminal charges as nurses and doctors are now speaking out about the non-standard public health protocols used at the Endoscopy Center of Southern Nevada, owned by gastroenterologist Dr. Desai.

40,000 are being urged to be tested for the contagious liver disease, hepatitis C and B and HIV.

Six confirmed cases have been linked to the center and the reuse of a syringe on a patient with hepatitis which then contaminated a vial of sedative used on other patients.  Five of the six cases visited the center on the same day.

A class action lawsuit has been filed through the law firm of White, Meany & Wetherall.

Former patient Charles Anthony Rader, 53, heads the class. This former Air Force medic had some digestive problems and was tested at the Endoscopy Center more than one year ago. He and his wife are now undergoing testing for hepatitis and HIV.

Dr. Desai’s statement follows:

LAS VEGAS, March 10 /PRNewswire/ -- As a longtime resident of Southern Nevada, I share our community's sorrow and concern for those who have been affected by this situation. I understand that many have questions about the allegations which have been levied against me and the Endoscopy Center of Southern Nevada. While I wish I were allowed to answer those questions, I am unfortunately unable to do so at this time on the advice of legal counsel. These unfounded allegations will be addressed in a court of law, when facts have been presented and substantiated. I look forward to that day, when I will be afforded the right to due process to which we are all entitled as Americans. #
